COURT ORDER DT 22 DEC 2025 PASSED IN CS NO 519-2025


 

1.     This is for info of all wherein an extract of an order of the Honorable Patiala House Court Delhi dt 22 Dec 2025 in CS no 519-2025 is stated below: -

Para 18 of court order dt 22 Dec 2025: -


 

         In my considered opinion, plaintiff could not have been suspended by merely issuing a letter and without following due procedure and without seeking approval of the General Assembly and the Observer. As such, all three parameters i.e. prima facie case, balance of convenience and irreparable loss are in favour of the plaintiff. The application of the plaintiff under Order 39 Rule 1 and 2 CPC is allowed and following reliefs as prayed under Order 39 Rule 1 and 2 are granted: -

(a)    Injunction is granted in favour of the plaintiff on the operation of the minutes of the Executive Committee Meeting of Defendant No.1 dated 21st August 2025 and all consequential actions arising from the meeting including the suspension of the Plaintiff till the disposal of the suit.

(b)    Injunction is granted restraining Defendant No.3 from representing himself as the Acting Secretary General of Defendant No.1 till the disposal of the suit.

(c)  The official email address of the Secretary General i.e., efiindianf@yahoo.co.in should be used to represent the Secretary General of Defendant No.1 for all official communications till the disposal of the present suit.

(d)   The Canara Bank, Dhaula Kuan, New Delhi is directed to allow Secretary General and Treasurer as signatories for operation of account No. 90302010013740 and the debit freeze on Account bearing No. 90302010013740 be removed till disposal of the present suit.

(e)  The HDFC Bank, Gopinath Bazar, Delhi Cantt, New Delhi is directed to allow Secretary General and Treasurer as signatories for operation of account bearing No. 50100834333598 and the debit freeze on Account bearing No. 50100834333598 be removed till disposal of the present suit.
